Terms & Conditions of Hire

EQUIPMENT

Means all equipment included in the hire

 

SECURITY DEPOSIT

1. Payment of the full sum due is required to secure your booking with Aberdeen Garden Parties.

2. Deposits are non refundable, except in the event of extreme or adverse weather making it impossible to erect the equipment.

 

HIRE PERIODS

On placement of your order, an agreement between Aberdeen Garden Parties and you regarding delivery and collection will be made. The equipment must be delivered and collected at the agreed time to avoid encroaching on other bookings. Failure to comply to agreed terms could result in loss of the deposit and hire.

We try to give appropriate time for delivery where possible but factors including traffic and delays at previous customer deliveries can delay this time, we will inform you of any delays and try to arrange with you an alternative time for delivery where possible, deliveries are conducted between 8am & 6pm on your first hire day.

 

YOUR RESPONSIBILITY WHEN HIRING THE EQUIPMENT

1.We will ask for your assistance when dropping off and collecting the equipment at your location. You must supply us with clear instructions, and take all reasonable steps to ensure the safety of our team. The equipment must be in a safe location – Aberdeen Garden Parties team will assess on arrival as it could result in termination of the booking if deemed a risk of being damaged or stolen.

2. It is the responsibility of the client to ensure that the site can accommodate the size of chosen equipment.

Each Gazebo or Bell Tent requires requires an additional one metre diameter for pitching on all sides.

For example, a 6m Gazebo requires 8m grass diameter for pitching, and a 5m Bell tent requires 7m grass diameter for pitching.

3.Occasionally in torrential wet conditions the equipment may let in a small amount of water.   If weather conditions are very windy please check the guy ropes regularly and make sure the pegs are secured.

4. Please do not smoke or use barbecues in or around the equipment.

5.Bell tents are not suitable for dogs or cats, and no pets can be allowed inside the bell tents.   If any evidence of this has occurred this will result in an additional charge to pay for a deep clean of the tent or a bill for the full value of a replacement of tent if it is ripped.

6. All rubbish/recycling must be removed at the end of your event prior to collection. Aberdeen Garden Parties reserve the right to levy a charge, which will be deducted from your security deposit, for the removal of any rubbish or waste left in the tent.

7. Aberdeen Garden Parties accept no responsibility or liability for damage or theft to any property left in the equipment for the duration of the hire period..

8. Aberdeen Garden Parties accept no responsibility or liability for damage or injury to any member of your party that may occur whilst you are in occupation of the equipment.

9. You will book a pitch or confirm the site is a private residence home that is accessible for Aberdeen Garden Parties to access their vehicle and erect the equipment. If Aberdeen Garden Parties are given incorrect information regarding the site and cannot access it the contract may be terminated and all deposits will be non-refundable.

 

ABERDEEN GARDEN PARTIES UNDERTAKINGS

1. Aberdeen Garden Parties will deliver, erect and furnish your equipment to the agreed location on the first day of the commencement of your booking.

2. Aberdeen Garden Parties will dismantle and remove all equipment from your event location on the day of termination of your hire period.

3. While Aberdeen Garden Parties will do everything possible to ensure your equipment is erected at the agreed time and date, no responsibility or liability can be accepted for delays due to road accidents or severe traffic problems.

 

CANCELLATIONS

1. If you wish to cancel your booking once you have paid your initial deposit please notify us immediately. In these circumstances your initial deposit is non returnable and any contract is rendered void.

2. If you cancel once you have paid the full cost of your tent hire, we are unable to return any monies to you, unless we are able to rebook the equipment for the period in question. In these circumstances we may offer the tent(s) at a reduced rental to encourage a late booking and any money we recover we will refund to you.

3. In the event of extreme or adverse weather conditions making it impossible to erect the equipment, Aberdeen Garden Parties cannot accept any responsibility or liability for losses or other costs incurred as a result. In this situation we will work with you to offer you and alternative site/date, where possible.

4. Aberdeen Garden Parties reserve the right to cancel your hire booking at any time. In the unlikely event of this happening, a full refund will be made, however Aberdeen Garden Parties will not accept responsibility or liability for losses or any other costs incurred as a result.

5. Should your chosen location cancel or terminate your booking for any reason whatsoever, no refund will be given by Aberdeen Garden Parties. In this case, please contact us as a matter of urgency and we will do our utmost to help you find an alternative site.

 

LOSS & DAMAGE

1. You shall throughout the period of hire be responsible for the maintenance and the safe custody of all equipment.

2. You must be satisfied with the equipment before use and should notify Aberdeen Garden Parties of any miscounts, incorrect deliveries and unacceptable equipment before use. Failure to do so will be the responsibility of the client and NOT Aberdeen Garden Parties.

3. You shall cover Aberdeen Garden Parties against the full value of any loss, damage or excessive soiling howsoever caused, unless caused by negligence by Aberdeen Garden Parties.

 

HEALTH AND SAFETY

1. Aberdeen Garden Parties operate a STRICT NO SMOKING policy inside the equipment.

2. Candles with flames are not permitted inside the equipment. Battery operated candles are permitted.

3. For your protection and safety, cooking is prohibited inside the equipment. Fire pits and BBQs can cause fires and the release of deadly carbon monoxide.

4. Fire pits should be sited a safe distance (a minimum of 4m) from the equipment and should not be left unattended.

 

THIRD PARTY LIABILITY

1. You agree that Aberdeen Garden Parties and its team accept no liability for any personal injury or damage to any persons or property suffered during the hire period howsoever caused, and will indemnify Aberdeen Garden Parties against all claims, unless it is proved that injury or damage was caused by faulty material or workmanship or negligence on the part of Aberdeen Garden Parties.

2. Your statutory rights are not affected.

3. You expressly acknowledge that Aberdeen Garden Parties are not the original manufacturer or supplier of the equipment.

 

LEGAL DETAILS

1. Force Majeure (unforeseeable circumstances preventing someone from fulfilling a contract) Aberdeen Garden Parties cannot accept any responsibility or liability for losses or other costs incurred as a result of: acts of God including fire, flood, storm or natural disasters, war, sabotage or acts of terrorism, government sanctions, labour disputes including strikes, lockouts, boycotts or other Industrial action, failure in the transportation of equipment or in the provision of services.

2. Services.  Aberdeen Garden Parties will not be responsible for any damage to underground services

3. Governing Law & Jurisdiction. This agreement and disputed or claims arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) are governed by and construed in accordance with the laws of Scotland.

4. The parties irrevocably agree that the Courts of Scotland have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with this agreement or its subject matter or formation (including non-contractual disputes or claims).

 

OUR RIGHT OF ACCESS

You agree to Aberdeen Garden Parties team entering any land or premises to remove Aberdeen Garden Parties’ equipment.

 

HIRER RESPONSIBILITIES

a. To listen to all instructions during set up. Failure to follow the instructions my result in a less enjoyable hire for which we are not responsible. If you need help during your hire, please contact us immediately.

b. Once the equipment is left in your care. You are responsible for its condition, cleanliness and usage.

c. The hirer is responsible for the safety and well being of all users.

d. Where you have not adequately insured the equipment, any accidental damage/theft of the equipment shall be replaced within 48 hours of collection up to the full replacement rate

e. The hirer will notify Aberdeen Garden Parties in writing of the location of underground services where the gazebos or bell tents are to be erected

 

OTHER TERMS

a. If any terms in this contract cannot be enforced or agreed to, then the hire of Aberdeen Garden Parties equipment will not be supplied.

b. By hiring our equipment, you agree to release Aberdeen Garden Parties and any of its team from any and all liabilities incurred during the hire or use of the equipment.
